General Terms and Conditions

 

About us

Circle4Care is a mobile software application (“The Application”) that can be downloaded and installed on a smartphone or tablet (“The Device”). The operator of the web-module https://app.circle4care.org is AZPM Ltd. (“The Company”), UIC 208275146. 1. General

1.1. The General Terms and Conditions for the use of the Application regulate the relations between Circle4Care and the Users, as well as the rights, obligations and responsibilities of each one of them.

1.2. The User is entitled to use the Application after expressly providing an online statement, including through a confirming action, that he/she is 18 years old or older and of full legal capacity, that he/she understands the General Terms and Conditions and accepts them entirely. 

1.3. In the event that the Application is used by persons below the age of 14, the actions for registration and acceptance of the General Terms and Conditions will be performed, instead of them and on their behalf, by their parents (legal representatives) and when it is used by underage persons aged between 14 and 18 years – with the consent of their parents (legal representatives).

1.4. “User”, in the present General Terms and Conditions, will be any natural person of legal capacity who wishes to use Circle4Care, accepts the present General Terms and Conditions and has expressed this by registering, or accepting an invitation to register, in the system as a User.

1.5. The User accepts and voluntarily and expressly agrees that the use of the Application is his/her own exclusive responsibility. The User will be responsible to ensure that all persons who have access to the Application through their device or Internet connection understand these General Terms and Conditions for use and all applicable terms and conditions and that they will be observed.

1.6. The User bears the entire responsibility for keeping his/her password secret and not allowing third parties to use his/her registration. All actions performed through the User’s profile will be deemed as performed by him/herself personally, unless it is found otherwise, following the due procedure.

1.7. The registration performed according to the preceding text represents an electronic statement with which the User declares that he/she wishes to use the Application, is familiar with the present General Terms and Conditions, accepts them entirely and assumes the obligation to observe them.

1.8. The User is entitled to a single registration at https://app.circle4care.org/login in which he/she is obliged to specify correct and true data and, in the event of any change – immediately reflect it in his/her registration.

1.9. Circle4Care will be entitled, at its own discretion and without prior notice, to terminate User registrations in the event of violation of the rules for the use of the Application or of the present General Terms and Conditions.

2. About the Application

2.1. The Application is an online platform for sharing information between a Person who receives care (Family Bond) and those who provide care for him/her – Family Administrator (Family Admin), Family Circle (Family Members) and Carer (Assistant). Each one of them has the User capacity.

2.2. By developing the mobile application, Circle4Care offers a single software technological solution that will assist elderly people and people in need of additional care to continue leading a relatively independent life while, at the same time, their health and wellbeing will be tracked and remain under the supervision of a close family circle and the person who provides care (Assistant), if any. In this manner, the Application makes it possible to share information within a closed circle of people.

2.3. Circle4Care does not monitor, control, manage nor approve the content which is shared among Users. This information is shared only in the respective Circle – space of the persons who will use the application without third parties having access to it. In view of this, Circle4Care will not bear responsibility for the content and quality of the information or for any damages resulting from it. 

2.4. By using the Application you accept the rules provided in the General Terms and Conditions and our Privacy Policy. It will be required of you to accept these terms and conditions as part of your registration in the Application and the use of its functionalities. You cannot use the Application, if you do not accept to be bound by these Terms and Conditions.

3. How does the Application work?

3.1. Through the web module the Family Admin creates a space (Circle) for the persons who will be using the application (Users) and sends an invitation for installation of the Application to each one of them. 

3.2. The Circle consists of the Family Admin and the participants invited by him/her. The number of the participants in the Circle is established and described in the different subscription plans (if subscription applies). The Family Admin is the person who chooses which subscription plan to pay for (if subscription applies).

3.3. A circle of people who can use the Application includes the following roles:

Family Admin;
Family Bond;
Family Members;
Assistant (if any).

3.4. The Application supports four modes combined in one application and it is possible to share information about the Family Bond among them. The Application can be downloaded from Google Play and App Store.

3.5. The Family Admin is the person in the family who creates his/her user profile in the Application and pays a monthly or yearly subscription for its use (if subscription applies). Through the web module of the Application the Family Admin forms a Circle of the persons who will be using the Application and sends an invitation to each one of them. The Family Admin creates profiles for the Family Bond and the Assistant (if any) in which he/she enters the entire information about them. He/she also sends an invitation to the Family Members to install the Application by entering their email address, including data about their family relation with the Family Bond.

3.6. The Family Admin pays a monthly or yearly subscription for the right to create and administer a Circle (if subscription applies). He/she is also the person who performs the initial registration in the Application through the web module, with all ensuing rights and obligations envisaged in the General Terms and Conditions.

3.7. Family Bond is a user of the Application whose personal health information will be shared by means of the application between the Family Bond him/herself, the Family Members, and the Assistant (if any). The profile of the Family Bond is created by the Family Admin. The Family Bond installs the Application on a device and sees the entire information about him/herself which was entered by the Family Admin, but cannot change it. The Family Bond can add photographs, as well as see the photographs and Stories in photographs shared by the other participants. These photographs and comments are also visible to the other participants in the Circle, with the exception of the Assistant.

3.8. The Family Members are users of the Application who have family or other relation with the Family Bond. The Family Members profiles are created by the Family Admin who inputs their email addresses and family relation with the Family Bond. After that, the Family Admin sends by email an invitation to the Family Member to install the Application. The Family Members do not have access to change the information of the Family Bond, they can only see it. They can share photos and Photo stories.

3.9. The Assistant is a user of the Application who is invited by the Family Admin as an assistant of the Family Bond. The profile of the Assistant is created by the Family Admin. The Family Admin inputs information about the Assistant and sends him/her an invitation to install the Application. The Assistant installs the Application on his/her device and sees the information about him/her which was entered by the Family Admin. This information is also visible for the other participants in the Circle. The Assistant has access only to the information about the Family Bond which was added by the Family Admin. The Assistant can add photographs, but cannot see the photos and Photo stories added by the Family Members and the Family Admin.

3.10. The invitation from the Family Admin to the Family Bond and the Assistant is served by sending an automatically generated code to log in the Application or a link to access the Application, sent to the recipient of the invitation.

3.11. The main information shared by the participants in the Circle is entered by the Family Admin. This information relates to:

3.11.1. The state of health of the Family Bond;

3.11.2. A list of medicines that the Family Bond should take – dosage and other information added by the Family Admin and related to the intake of medication;

3.11.3. A list of planned doctor appointments containing information added by the Family Admin concerning the date, hour, place of the examination and the doctor who will perform it.

3.12. The mode of the Application for the Family Bond and the Assistant was developed with a functional design, specifically made for elderly people (large icons and texts), in view of facilitating the Users in the use of the Application. 

4. Technical requirements for the use of the Application. Technical maintenance

4.1. To use Circle4Care, you will need:

4.1.1. A device supporting the operating system iOS 12 or a more recent version, or a device working on Android v 8 or a more recent version. In view of the fast development of technological processes, the list of the versions supported by the Application may be updated and it is available at  https://circle4care.org/en

4.1.2. Steady internet connection.

4.2. The Application can work on a single Device of a single User simultaneously. 

4.3. We recommend that you always use the latest version of Circle4Care, in order to take advantage of all functionalities and the elimination of bugs or software defects.

4.4. The technical support of the Application will be carried out every work day – from Monday to Friday, from 9 a.m. to 6 p.m., excluding weekends and the days which are official holidays in the Republic of Bulgaria.

4.5. Circle4Care provides support by email at the following email address: [email protected]. Each inquiry will be processed on a first-come first serve basis. The time for sending a response to the inquiry will be from 1 to 2 work days counted from the moment the inquiry was received. For matters requiring technical intervention, the time to solve the problem will depend on its complexity and will usually take 2 to 5 work days.

5. How do we use your personal information

5.1. Circle4Care uses the personal information provided by you only in accordance with the Privacy Policy. For more details see the Privacy Policy.

5.2. Circle4Care stores the data of its Users under confidential terms, according to the Law on personal data protection and will not disclose them to third parties without the express written consent of the Users or only in cases regulated by the existing legislation and only to the institutions expressly specified in the law. 

6. Policy for the use of cookies

6.1. The provider is entitled to install on the computers or other end devices of the Users “cookies” – small text files which are stored by the web page through the web server on the hard disk of the User’s device and allow to restore information about the User, identify him/her and track his/her actions in the site. The “cookies” can be installed by the supplier and/or third parties for the purpose specified above during the User’s visit to the platform: https://circle4care.org/en/ Information about the cases where “cookies” are installed by Google Inc. and in relation to the use of the Google Analytics service by the Supplier, as well as about the User’s right to refuse them, can be found at support.google.com/analytics/. By accepting these General Terms and Conditions the User expressly states his/her consent to the possibility for access, gathering and storage of data related to him/her through the Google Analytics service and the Supplier is obliged to treat such data as personal.

7. Subscription plans and payment method

7.1. In order for a specific Circle to use the Applications, the Family Admin pays a monthly or yearly subscription (if subscription applies). The price of the specific subscription plan will depend on the functionalities of the Application selected by him/her. 

7.2. The payment of the subscription fee (if applicable) is made through the Stripe platform (https://stripe.com). Information on the manner of making and processing the payments and the terms for reimbursement can be found at https://stripe.com.

7.3. The Family Admin must add a payment method in the Circle4Care system (Stripe payment card) before the expiry of the 30-day trial period (if applicable). Otherwise, access to the Circle will be suspended for all participants in it, until a payment method is entered into the system. After specifying a payment card in the system, the subscription fee will be withdrawn automatically upon the expiry of the 30-day trial period.

7.4. In the event that the Family Admin has not paid the fee (if applicable) within the specified deadline, Circle4Care will send an invitation for its payment by email. If the failure to pay continues after this invitation, the access to the Application will be limited and the Users of a specific Circle will not be able to use it. 

7.5. The Family Admin is entitled to terminate the subscription plan requested by him/her at any time.

7.6. In the event that the Family Admin requests the termination of the yearly subscription plan (if applicable) within 30 (thirty) calendar days of its purchase, Circle4Care will reimburse the entire amount paid, according to Stripe’s terms for the reimbursement of paid amounts, which can be found here: https://stripe.com. 

7.7. In the event that the Family Admin requests termination of the monthly subscription plan (if applicable), Circle4Care will not reimburse the amount paid for it and the Users will be entitled to use the requested service until the expiry of the paid monthly subscription.

7.8. Circle4Care is entitled to change the subscription fees for the use of the Application unilaterally before the entry into force of a new subscription period, for which it will notify the User by sending an email message. The current prices of the subscription plans are published at https://circle4care.org/en/

7.9. The Application grants a free of charge 30-day Trial Period in case there is a subscription, during which the User has the possibility to try the functionalities of the Application and check whether it works correctly on the different Devices on which it was installed. 

7.10. The list of the Devices on which Circle4Care recommends to install the Application and the resolution supported by the Application are available at https://circle4care.org/en/

7.11. In the event that, after the expiry of the Trial Period, the User changes the device with another one, Circle4Care cannot guarantee that the Application will work correctly on all types of newly appeared devices, resolutions and operating system versions.

8. How we use the information about your payment cards

8.1. Circle4Care does not store any information on credit or debit cards. This information is maintained and the payments are processed by a supplier of payment services – a third party, in accordance with the payment card industry safety standards. 

9. Limited liability

9.1. Every User using the Application expressly agrees that he/she bears full responsibility for the veracity of the data and information provided by him/her, including the data and information provided on another person from a specific Circle, such as, for example, but not only, about the health status of a Family Bond, the list of medicines which a Family Bond should take, the list of previous and planned doctor appointments.

9.2. By accepting the present General Terms and Conditions you confirm that you understand and accept the following:

9.2.1. Without Internet connectivity the Application will not operate correctly. 

9.2.2. The Application visualizes to the Family Bond and the Assistant the information entered by the Family Admin, in the manner configured by the Family Admin.

9.3. Circle4Care will not be liable when a possible risk has arisen or if possible damages have occurred which are directly or indirectly caused by the above circumstances or are the result of using the Application without taking the present General Terms and Conditions in consideration.  

9.4. Circle4Care will not be liable in the event that:

9.4.1. The Family Admin has not entered correctly the information about the state of health of the Family Bond, the list of medicines that a Family Bond has to take, the list of previous and planned doctor appointments.

9.4.2. It is not possible for the User to use the Application due to technical causes (a hardware or software problem of the Device, an Internet connectivity problem, etc.).

9.4.3. Damages have arisen due to technical causes, independently of the circumstances which have led to that – technical problems, technical maintenance, etc.

9.5. You expressly agree that, to the extent allowed by the applicable law, Circle4Care or its officers, employees, directors, parent companies, subsidiaries, related parties, representatives and licensors will not be liable for any indemnity whatsoever for direct, accidental, special, subsequent damages, or such of an exemplary character, including, but not only, indemnity for lost revenues, profits, goodwill, use, data or other intangible losses, resulting from or related to your use of the Application, independently of weather this indemnification for damages is based on a contract, delict (including negligence and objective responsibility), guarantee, statutes, etc.

9.6. You expressly agree to defend and release from any responsibility Circle4Care, its officers, directors, employees, representatives, subsidiaries, related parties, licensors and suppliers, from and against any claims, lawsuits, requirements, responsibilities and agreements derived or which are presumed to derive from a violation of these General Terms and Conditions on your part. 

9.7. Circle4Care reserves its right to place advertising materials at https://circle4care.org/en/ in a manner that it deems appropriate and will not bear responsibility for the content of the advertising materials.

10. Important restrictions for the use of the Application

10.1. In order to use the Application, you will have to provide your personal data (see Privacy Policy).

10.2. The personal information („Information“) which is provided to the Application will be collected, processed, stored, disclosed and deleted in accordance with the applicable EU law and the Privacy Policy.

10.3. The Application cannot and does not seek to replace the personal care to a Family Bond, it solely seeks to facilitate the process of information sharing among the persons in the specific Circle.

10.4. These terms and conditions and the use of the Application follow the Bulgarian legislation and Circle4Care will not bear any responsibility for laws outside of the Republic of Bulgaria. Herewith you agree that, in the event of any disputes related to the present terms and conditions or the use of the Application, the disputes will be referred to the competent court in the Republic of Bulgaria.

10.5. If you violate any of these terms and conditions when using the Application, Circle4Care may ban your access to the Application or deactivate your account.

10.6. Circle4Care reserves its right to deny access to the Application in the listed, but not exhaustively, cases, namely:

10.6.1. When a due payment to Circle4Care was not made (if subscription applies);

10.6.2. When with his/her actions the User violates the General Terms and Conditions and other obligations resulting from the legislation;

10.6.3. When with his/her actions the User deliberately or involuntarily hinders third parties from using the Application.

10.7. Each User will be obliged:

10.7.1. Not to provide information which is false, inaccurate or misleading;

10.7.2. Not to violate the rights, legal interests and reputation of third parties;

10.7.3. Not to abet to commit crimes or other transgressions of the law;

10.7.4. Not to perpetrate other malevolent acts;

10.7.5. To inform Circle4Care immediately of any case of a detected violation of the present General Terms and Conditions;

10.8. The Family Admin, in particular, will be obliged, in addition to observing the above conditions in item 10.7, to pay the fee for the use of the Application.

10.9. In the cases where a User uses fully or partially the information from the Application in a manner contradicting the Law on copyright and related rights, he/she will bear responsibility for all caused damages and lost benefits.

10.10. By accessing the Application you agree that you will not commit acts that could jeopardize the correct operation of the Application, the reputation, interests or rights of Circle4Care or of any of its partners or which could hinder in any way the normal use of the Application by other visitors.

11. Right to make changes

11.1. Circle4Care will have the right, at its own discretion, to modify, add or delete parts of these General Terms and Conditions at any time in the future. Circle4Care will inform you of such changes upon every subsequent entry into the platform. If, after being notified of such changes, you continue using the Application and its functionalities, this will mean that you confirm these changes and accept to be bound by the revised Terms and Conditions which include these changes.

11.2. Circle4Care reserves its right to change the form and content of https://circle4care.org/en/ and the Application at any time, including the design, form, technology and services offered by it, without advance notice.

11.3. Circle4Care is entitled, at any time, to stop the operation of the Application for a short period of time, with the goal to renew the content or for other reasons.

11.4. Circle4Care reserves its right to stop, at its own discretion, part of the functionalities of the Application or to restrict the access to them, for all Users or for specific Users.

11.5. Circle4Care reserves its right to terminate, at its own discretion, the operation of the Application, sending a notification to its Users at least 2 weeks before that and/or publishing a notice on its website. Users who have paid for a subscription will receive a compensation (reimbursed subscription) for the period which was paid, but it will not be possible to use the Application. 

12. Special rules

12.1. In the event that the Family Admin creates a profile for his/her child in Family Bond mode, please, have in mind that parents accept the General Terms and Conditions on behalf of their children aged from 0 to 14 years and together with their children aged between 14 and 18 years.

In the event that the Family Admin creates a profile for his/her child as Family Member, please, have in mind that parents accept the General Terms and Conditions on behalf of their children aged from 0 to 14 years and together with their children aged between 14 and 18 years.

12.2. These General Terms and Conditions enter into force from the 26th of May 2025 and/or upon publication of their latest update.
